You should read this Privacy Policy (the “Privacy Policy”) carefully, as it governs use of Personal Information in relation to the Services.

This Privacy Policy is a legal agreement between Mitutoyo Canada Inc. and Mitutoyo Corporation together with their subsidiaries, affiliates, and partners (hereafter, “Company”, “us”, “our”, “we”) and you (“you” or “your”) which governs the Company’s relationship with you in respect of your use of the Company website and services (collectively, the “Services”).

Accessing and/or using any of the Services is the equivalent of your signature and indicates your acceptance of this Privacy Policy and that you intend to be legally bound by this Privacy Policy.

IF YOU DO NOT AGREE TO THIS PRIVACY POLICY, YOU MUST NOT ACCESS OR USE THE SERVICES.

The Company reserves the right at any time and from time-to-time to modify, edit and update the Privacy Policy and shall do at its sole discretion. You should review the Privacy Policy regularly to make sure that you are aware of any changes. Your access to use of the Services on and after the date on which revised terms are posted constitutes your acceptance of the Privacy Policy as revised.

the Company recognizes that the protection of information that can identify individuals (hereafter “personal information”) is a social duty of the Company and an important task for business operations, and is thus committed to implementing the following privacy policy.

  1. Formulation and continuous improvement of compliance program for the protection of personal information.
    The Company educates its executives and employees about the importance of personal information, has formulated a compliance program for the protection of personal information, and is systematically implementing it. Further, the Company is committed to maintaining and continuously improving this program.
  2. Collection, use and distribution of personal information.
    Along with establishing a management system for personal information according to operating conditions within the Company, the Company will carry out the collection, use and distribution of personal information in an appropriate manner according to the applicable rules and regulations.
  3. Implementation of safety measures.
    The Company will devise rational safety measures to ensure the accuracy and the safety of personal information, protecting it from illegal access, leaks, destruction, loss, and alteration.
  4. Respect of rights of information subject.
    The Company will respect the rights of the information subject as pertain to personal information, and if the information subject requests disclosure, correction, or deletion of own information, or refuses the uses or distribution of own information, the Company will comply insofar as reasonable in light of conventional wisdom and customs.
  5. Observance of laws pertaining to personal information.
    The Company will observe laws and ordinances that apply to the handling of personal information. Moreover, the Company will design its compliance program for the protection of personal information so that it reflects such laws and ordinances.

The Handling of Personal Information

The Company has established a personal information protection policy for the suitable protection and management of the personal information of our customers.

The following outlines major points regarding the handling of the personal information of customers held and managed by the Company.

Purpose of use of personal information

Personal Information

For the purposes of this Privacy Policy, the term “Personal Information” means any information that is defined to be personal information under applicable privacy laws. Usually, personal information refers to any information about an identifiable individual or any information that can be used to identify an individual. Personal Information may include, for example, your name and home address, your date of birth, payment information, your occupation, medical conditions or other health information, your personal financial records or credit information, certain video or images of you, or any personal identification numbers. Publicly available information, such as information in a public directory, is not Personal Information under this Privacy Policy.

Consent for the collection, use and disclosure of Personal Information

Some privacy laws require us to obtain the consent of an individual to the collection, use or disclosure of Personal Information in many circumstances. Providing us with your Personal Information is always your choice. By accessing our Services, or by submitting your Personal Information to us, whether or not via the Services, you consent to the collection, use, and disclosure of such information in accordance with this Privacy Policy and as otherwise permitted or required by law.

When we receive Personal Information from you for the purposes of providing you with our Services, or for other uses identified herein, you are providing us with consent as follows:

  1. to allow us to deal with that Personal Information in a reasonable manner, and to deal with Personal Information as set out in this Privacy Policy;
  2. to allow us to provide your Personal Information to third parties we engage to provide or support the Services;
  • to allow us to use and store your Personal Information for the purpose of providing you with the merchandise you purchase from us and to utilize the Services; and
  1. to allow us to transfer your Personal Information outside of your home jurisdiction (whereby your Personal Information will be treated in accordance with applicable laws of the jurisdiction to which it is transferred) for the purpose of storage, processing and use of your Personal Information by us. For clarity, such transfers may include the transfer of Personal Information outside of Canada and inter-provincially within Canada.

If you need to provide us with Personal Information about other individuals, you hereby represent and warrant to us that, where required by law and prior to your disclosure to us, you will obtain the consent of each individual to the collection, use and disclosure by us for the specific purpose(s) that the disclosure is made by you, including all purposes set out herein.

If we sell our organization or merge with another party, you hereby consent to the transfer of your Personal Information and all information you provide to us, to our successor for the same purposes as set out in this Privacy Policy.

Consent Exceptions

There are some legal exceptions where we will not need to obtain consent or explain the purposes for the collection, use or disclosure of Personal Information. Some examples of situations where consent is not required include an emergency that threatens the life, health or security of an individual, or if we must comply with a court order or governmental order.

We may use Personal Information without your knowledge or consent in limited circumstances whereby we are required to provide Personal Information to third parties for legal or regulatory purposes. For example, under certain exceptional circumstances we may have a legal duty or right to disclose Personal Information without your knowledge or consent. Within Canada various government agencies such as the Canada Revenue Agency, Human Rights Commission, Canadian Radio-television and Telecommunications Commission, and law enforcement, may have the authority to review our files and interview our staff when deemed necessary. These agencies have their own strict privacy obligations.

Use of Personal Information

The personal information of customers (name, contact information, etc.) may be used for the following purposes by the Company, and you hereby consent to all such uses of all the personal information that you provide to the Company, whether through the Services or otherwise.

  1. Introduction of products handled by Mitutoyo (measuring instruments, testing equipment, precision instruments, and other products)
  2. Provision of and guidance about after-sales services for the products handled by the Company
  3. Provision of information about exhibitions, seminars and other events
  4. Marketing surveys
  5. Communications regarding the Company’s operations
  6. Should any of our Services involve fees being provided via an electronic payment service, such electronic payment service may be facilitated by a third party service provider on our behalf. Any payment information you provide may therefore be provided to such third party service provider, and you hereby provide consent to our disclosure of your payment information for that purpose
  7. Uses in accordance with our Terms of Use, including administration of any user account you may have for the Services
  8. Your information may be used to help us to more effectively respond to your customer service requests and support needs

For clarity, any uses above that require consents or authorizations under anti-spam laws, shall be provided in accordance with anti-spam laws. And for such uses we may obtain your consent in order to send you commercial electronic messages.

Failure to provide Personal Information or anti-spam consents and authorizations may cause you to be unable to utilize the Services or some aspects of the Services.

Management of Personal Information

The Company has devised and implemented strict safety measures to prevent the loss, destruction, alteration, leaks, and illegal access of personal information, according to the applicable laws and ordinances. Moreover, in the case of outsourcing or subcontracting, such as of shipping services, the Company will select only companies that have signed the required confidentiality agreements, and ensure proper handling.

NOTWITHSTANDING THE FOREGOING, THERE ARE INHERENT RISKS TO ANY TECHNOLOGY HOWEVER REMOTE THAT COULD CAUSE SECURITY PROTOCOLS TO FAIL OR TO BE BREACHED AND WHICH COULD RESULT IN THE UNAUTHORIZED COLLECTION, USE OR DISCLOSURE OF YOUR PERSONAL INFORMATION.

A cookie is a data file transmitted from a website to a customers’ computer. When the customer visits that website again, the website can read data from the customer’s computer.

This website uses cookies for some pages, which are used to save the Company’s customers from having to repeatedly input answers and collect information such as the pages visited by the customer.

Children’s Privacy

We are committed to protecting the privacy of children. Our Services are not intended for children under 16 years of age. No one under age 16 may provide any information on the Services. We do not collect personally identifiable information from any person we actually know is a child.  If we learn we have collected or received personal information from a child under age 16 without verification of parental consent, we will delete that information.

Information Accuracy

While we collect the Personal Information that you supply, we do so with the understanding that any such information is accurate. It is important to us that your Personal Information held by us is accurate and complete. Having accurate information about you enables us to provide you with the Services in a manner whereby they function as intended. We will bear no responsibility for any action or omission as a result of our lack of accurate contact information for you, including any inaccuracy, malfunction or other deficiency of the Services.

Inquiries

Inquiries regarding the management of personal information by the Company should be addressed in writing to the following address. Should you wish to request disclosure, correction, etc., of your personal information, or request that its use be stopped, etc., please send this request in writing along with a copy of a personal ID with photo and a copy of your certificate of residence. The Company will mail a reply to the address listed on the certificate of residence. Please note that the Company will charge a fee for processing such requests.

We recognize that you may have the right to access your Personal Information. Any access request must be made in writing to our Privacy Officer, as identified below in the “Inquiries” section. In some situations, we may not be able to provide access to certain Personal Information as the right to access Personal Information is not absolute. If we do not provide you with the requested information, we will notify you in writing and explain our reason(s) for not fulfilling your request.

You may, at any time, withdraw your consent to our collection, use and disclosure of your Personal Information, subject to reasonable notice and any legal or contractual restrictions. Should you choose to withdraw your consent, we may be unable to provide, or continue to provide, the Services that can only be provided if we receive appropriate and required Personal Information.

Successors and Assigns

Our successors and assigns may collect, use and disclose your personal information for substantially similar purposes as described in this Privacy Policy.
